THE DATA PROTECTION BOARD EXTENDS DEADLINE FOR REGISTRATION WITH DATA CONTROLLERS’ REGISTRY AGAIN

The Data Protection Board (Board) has recently resolved to extend the deadline for registration with the Data Controllers’ Registry Information System (“VERBIS”). The decision no. 2019/387 on the extension was announced on the board’s website on 27 December 2019.

The Board had previously extended the timeline for the following data controllers’ obligation to register with VERBIS to 31 December 2019 with its decision dated 3 September 2019:

  • Real person and legal entity data controllers who employ more than 50 employees annually or achieved a total yearly actives on the balance sheet of 25 million Turkish Liras and
  • Real person or legal entity data controllers residing abroad.

Having established that there are inconsistencies with the controllers' implementation of the Law on Personal Data Protection numbered 6698 and the related regulations in a considerable number of submitted registrations, the Board extended the deadline for the above mentioned data controllers for another six months to 30 June 2020 with its most recent decision.

In addition, with the decision no. 2019/387, the Board decided that;

  • The deadline for registration with the VERBIS of the real person and legal entity data controllers who employ more than 50 employees annually or achieved a total yearly actives on the balance sheet of 25 million Turkish Liras and whose main area of activity is processing of personal data of special nature, is extended to 31 September 2020 from 31 March 2020, and
  • The deadline for public institutions and organization data controllers, registering with VERBIS is extended to 31 December 2020 from 30 June 2020.

The obligation to register with the registry is one of the fundamental obligations of the data controllers under the Personal Data Protection Law, and non-compliance with this obligation may lead to administrative fines up to TRY 1,000,000.
